Power of Attorney & Legal Help for Nepalis Abroad

In short

Gitanjali Law Firm acts for Nepalis living abroad who need legal work done in Pokhara: authorised power of attorney (अधिकृत वारेसनामा) attested at a Nepali embassy, protection of land in Kaski, divorce and partition cases run without returning home, and documents for use overseas.

Almost every family in Pokhara has someone working abroad, and legal problems do not wait for their next flight home. A power of attorney in Nepal executed from abroad — the अधिकृत वारेसनामा — is the instrument that lets an advocate in Pokhara act for you: appear in court, defend or file a case, register a transfer, apply to freeze a plot, or collect and file documents.

Power of attorney is governed by the National Civil Procedure Code, 2074 (Sections 144–155). If you are in Nepal it is executed and registered locally; if you are abroad it is executed before the Nepali embassy or consulate in your country and attested there, then used in Nepal. The document must state exactly which powers are granted — a vague authority gets rejected at the Land Revenue Office and a too-broad one is dangerous to give a relative.

We prepare the wording, tell you precisely what the embassy will require, and then do the work in Pokhara: cases at Kaski District Court, land matters at Malpot Kaski, and dealings with ward offices and the District Administration Office. Clients in Qatar, UAE, Saudi Arabia, Malaysia, Korea, Japan, Australia, the UK, the USA and across Europe run matters this way, with updates by WhatsApp.

How these matters are handled

  • The authority is drafted for a specific purpose: a vague authority is refused at the Land Revenue Office, and an unnecessarily broad one is risky to grant to anyone.
  • What will be done under the authority — and what will require fresh instruction — is confirmed in writing before it is used.
  • Requirements differ between Nepali missions, so the draft and checklist are prepared for the mission you will actually attend.
  • Where land is at immediate risk of transfer, an application to freeze the plot is the first step.

Power of Attorney (NRN) in Pokhara — frequently asked questions

Straight answers to what clients ask most often. If your question is not here, call or WhatsApp and ask it directly.

How do I make a power of attorney for Nepal while living abroad?

The document is prepared with the specific powers you want to grant, then executed and attested before the Nepali embassy or consulate in the country where you live, and sent to your authorised person or advocate in Nepal. Missions generally require your passport, photographs and the prescribed application together with the लिखतम् document, and each mission publishes its own attestation requirements. The wording is what decides whether the Nepali office concerned will accept it.

Can my lawyer in Pokhara sell or register my land under power of attorney?

Only if the authority expressly grants that power. The Land Revenue Office checks the wording, and a general authority that does not clearly cover registration of a transfer will be refused. This is deliberate protection for owners — and the reason a power of attorney given to a relative should be limited to exactly what is needed.

A relative is trying to sell my land in Kaski. Can you stop it?

Often yes, if you act quickly. Depending on the facts we can apply to freeze the plot, verify at Malpot Kaski whether a transfer has been registered, and initiate proceedings to set aside a transfer made without authority. Send the ownership certificate details by WhatsApp — speed matters more than paperwork at this stage.

Can I get divorced in Nepal without coming back from abroad?

In most cases yes, through an authorised power of attorney, with the case filed and conducted at Kaski District Court. Certain stages may require your presence or an appearance arranged in another manner; we tell you at the outset which those are for your specific case.

Can you provide documents I need for immigration or a foreign court?

Yes — affidavits, relationship and single-status documents, notarised translations and certified copies, prepared to the requirements of the authority that will receive them. Tell us which country and which office needs the document, because the required form of attestation differs.
